JOB SUMMARY

We are seeking an experienced attorney with at least 3 years of experience to join the Sanofi North America (NA) Legal Department. This position will support US Market Access and US Marketed Products. This position reports to Head of Market Access Legal in Bridgewater, NJ and will work with other Market Access and Marketed Product attorneys in the Legal Department. This position will be based in Bridgewater, NJ. However, depending on the candidate, we are open to the position being in the Cambridge location.

Key responsibilities are as follows:

Ensure that client operations comply with applicable laws and company policies, including Anti-kickback Statute and other US healthcare compliance laws and regulations, antitrust, and FDA requirements;

Ensure that interactions with market access customers, health care professionals and patients comply with applicable legal requirements and company policies;

Work closely with internal teams to establish relationships and deliver consistent, practical legal guidance and support;

Draft, negotiate and review discount and rebate agreements, distribution agreements, and other market access agreements for portfolio products;

Analyze business initiatives for antitrust, fraud and abuse, FDA and other regulatory compliance;

Identify and analyze legal risks and propose appropriate actions to secure compliance with relevant rules, regulations, and policies;

Interact with and advise business leaders in the US concerning legal issues that have a direct effect on the success of the company;

Draft, negotiate, and review health care professional, vendor, licensing, consulting, speaker, advertising, sponsorship, and other agreements for commercial operations and medical affairs;

Analyze product promotional initiatives, advisory board proposals, speaker programs, and medical education initiatives for FCPA, fraud and abuse, FDA, and other regulatory compliance;

Advise on brand strategic planning and business operation plans;

Counsel and support business and technology teams by providing advice on legal, contractual and privacy requirements related to websites, mobile applications, and similar initiatives;

Review and advise on media relations materials including press releases, standby statements, Q & A documents, web sites and other company communications;

Ensure that clients are kept abreast of all relevant legal developments in their areas of business;

Counsel and collaborate with the Compliance department on policy interpretation, training, and other relevant activities;

Coordination of legal aspects of client projects;

Contribute to the achievement of clients’ business objectives;

Acts as Legal Department representative on cross-functional teams, as assigned; and

Coordination with and support of other members of the US Market Access Legal and US Regulatory Law groups plus support of GBU (Global Business Unit) Support colleagues, as needed.

The Corporate Counsel operates with limited supervision, and therefore requires a high level of balanced judgment and an ability to independently discern and establish priorities. Agility and willingness to learn about various subject matters (both from a legal and business perspective) are highly valued. Ability to identify potential legal issues (focusing on fraud and abuse, antitrust, promotional, and regulatory matters) as well as proposed solutions to mitigate risk is required.

Basic Qualifications:

  • At least 3 years of post-J.D. experience; and

  • Licensed to practice law and in good standing in at least one US jurisdiction—NJ, a plus.

Preferred Qualifications:

  • Excellent academic credentials, including a J.D. from a highly respected, accredited law school;

  • Prior experience as a member of an in-house legal department at a biotechnology or pharmaceuticals company;

  • Experience working in a matrix, international environment; and

Ability to provide and effectively communicate sound legal advice coupled with a strong understanding of business needs

  • Demonstrated excellence in (i) understanding and digesting complex scenarios in order to identify and evaluate relevant issues and risks, (ii) proposing solutions that take into consideration the relevant business objectives, and (iii) communicating those issues, risks, and solutions clearly and concisely to lawyers and non-lawyers alike;

  • Strong contract drafting and negotiation skills;

  • Sound judgment and commitment to ethical conduct;

  • Ability to effectively and efficiently manage outside counsel, when used, and adhere to a budget; and

  • Performs other duties as assigned.
